Terms of Use
1. Agreement
These terms govern your use of the ScrapLog app and web app (the “App”) provided by Armin Miranda (AMRV), Werkstattstraße 12, 50733 Köln, Germany (“we”, “us”). By using the App you agree to them. How we handle data is explained in our Privacy Policy. If you downloaded the App from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies; where the two conflict, these terms prevail to the extent permitted.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for documenting scrap yard visits for your own or your employer’s business purposes. You may not copy, modify, reverse engineer, resell or redistribute the App except as permitted by law.
3. Your content
Visits, photos, videos, drawings, comments, notes and other details you create in the App (“Your Content”) belong to you. We claim no rights to Your Content and never receive it.
You are responsible for Your Content and for having the right to capture and share it. In particular:
- obtain permission from the yard owner or operator where required before photographing or filming;
- respect the privacy of other people (for example faces, voices, vehicle license plates) and applicable recording laws — some jurisdictions require consent before recording conversations;
- respect confidentiality obligations and trade secrets of the businesses you visit.
4. Storage, export and backups
All data is stored only on your device. The App keeps several visits side by side until you delete them. We do not provide cloud storage, and the iOS app deliberately excludes Your Content from iCloud and computer backups, so we cannot recover lost or deleted data. Deleting items, piles or visits, deleting the App, or losing, resetting or replacing your device permanently removes Your Content unless you exported it. Export your visits regularly (PDF report or ZIP).
5. Metal types and ISRI grades
The metal types and ISRI grades in the App are provided as a convenience reference based on the ISRI Scrap Specifications Circular 2022. The list may be incomplete or out of date, and specifications change over time; the current official circular published by the Recycled Materials Association (ReMA, formerly ISRI) is authoritative. ScrapLog is not affiliated with, sponsored or endorsed by ReMA/ISRI. “ISRI” and the specification names may be trademarks or other property of their respective owners.
Grades, specs, drawings and comments you record, and the reports generated from them, are your own assessment. The App is not a grading or certification tool. Purchases and sales should be based on your contracts, inspections and certified scale tickets.
6. ScrapLog Pro subscription
The App can be used free of charge with its core features: capturing photos and videos, piles, metal types, ISRI grades, specs, one visit and ZIP export. ScrapLog Pro is an optional auto-renewable subscription that adds PDF reports, unlimited visits, photo markup and comments, ISRI favorites and the volume-button shutter. The features included may change over time.
- Purchase and billing. Subscriptions are sold and billed by Apple through your Apple Account. Prices are shown in the App before you subscribe and may vary by country.
- Free trial. New subscribers may be offered a free trial (currently 14 days), available once per Apple Account. If you do not cancel at least 24 hours before the trial ends, the subscription starts and the price is charged.
- Renewal and cancellation. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel it at any time in your App Store account settings; cancellation takes effect at the end of the current period.
- Refunds. Refund requests are handled by Apple under Apple’s terms. Statutory rights, including any right of withdrawal, remain unaffected.
- When the subscription ends. Your content stays on your device. You can still view it and export it as ZIP; Pro-only actions (such as new PDF reports, new visits beyond one, or new markups) are no longer available until you subscribe again.
7. Acceptable use
Do not use the App for unlawful purposes, including covert surveillance of people or recording in violation of applicable law.
8. No warranty
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the maximum extent permitted by law. We do not warrant that the App will be error-free or that data will never be lost.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or business, arising from your use of the App. Nothing in these terms limits liability that cannot be limited by law (for example for intent, gross negligence, or injury to life, body or health, or under mandatory consumer protection or product liability law).
10. Apple App Store
These terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for addressing claims relating to the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Changes and termination
We may update these terms; the effective date above shows the latest version. You may stop using the App at any time by deleting it. We may end or change the App at any time.
12. Governing law
These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of your country of residence remain unaffected.
13. Consumer dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 of the German Consumer Dispute Resolution Act, VSBG). If you have a problem, please contact us first. We will do our best to help.
